BigFiber.net, Acceptable Use Policy
This Acceptable Use Policy provides guidelines on the use of BigFiber.net's networks and resources that
both paying customers and non-paying users must adhere to at all times. This document also outlines BigFiber.net's
standard operating procedures and terms of service with respect to service accounts.

Violations of Acceptable Use Policy
1. Illegal Activity
Users of BigFiber.net's networks and resources are subject to all Canadian laws. This includes laws with
respect to copyright, defamation, privacy, unauthorized scanning of other networks and systems,
unauthorized access to systems or networks, child pornography, fraud, credit card theft, hatred
literature, and all other laws as set forth by the Canadian government. BigFiber.net will assist local
authorities as necessary in any case where illegal activity is detected.
2. Spam, Mailing Lists, and Newsgroups
BigFiber.net has a zero tolerance policy regarding spam e-mail. This includes sending unsolicited e-mail
advertising from servers on our network, linking to pages on our network from e-mail advertising sent from
other networks, improper collection of e-mail addresses for mailing lists, using our networks to post
advertisements to newsgroups, or advertising accounts that reside within our networks on any newsgroups. All
mailing lists must be assembled using e-mail addresses of recipients obtained through a double opt-in method
and all lists must include an unsubscribe link and legitimate contact info at the bottom of the mailing.
Double opt-in lists are best collected by having the user first knowing select that they wish to be on the list
and giving their e-mail address. The list may then send one message, and one message only, asking them to confirm
their subscription. The recipient will then have to either visit a link provided or reply to the message for the
double opt-in to be complete. Any spam complaints we receive will be forwarded to the appropriate account holder
along with a request for immediate explanation and resolution.
3. Unauthorized Access
Use of our network and systems to attempt to gain unauthorized access to any other systems or escalate privileges
on any system, or to gain access to private personal or business information will not be tolerated. Scanning,
probing or testing other systems without express consent from their owners will also not be tolerated.
4. Network Abuse
Use of our network and or any servers within our network to cause disruptions in service to other customers on
our own network or any other network is strictly forbidden. This includes launching Denial Of Service attacks or
provoking Denial Of Service attacks on our own or any other entity's networks. Other examples of network abuse
include over usage of resources such as utilizating more than the alloted bandwidth on plans with restrictions
in place, running scripts on our servers that will cause excess cpu or memory or any other resource usage,
distributed computing clients, DNS poisoning, network traffic with forged source addresses, and any other abnormal
network activity as determined by our staff.
5. IRC Activity
IRC, Internet Relay Chat, has become the single most targeted service on the internet today. Because of this,
IRC clients, bots, and servers are expressly forbidden on our network unless we are contacted first and a deposit
of $650 is placed on your account. In the event of a Denial of Service attack against your server or account
BigFiber.net will keep the $650 deposit and revoke IRC privileges until another deposit has been made. At
the termination of your account, if there have been no attacks, we will refund the $650 deposit to you.
Account Handling
1. Payments
All accounts will be paid at the time they are created. When an account is due for renewal the full payment amount
must be received before or on the due date. Accounts that remain unpaid will be subject to suspension until full
payment has been received. During suspension no files may be retrieved from the account.
2. Over Bandwidth
Each account type has an alloted bandwidth amount. Any transfers in excess of this amount will be billed to the
account and payable within 7 days from the end of the account's payment period. As with normal payments, if
this amount is not paid in full the account may be subject to suspension until such time as payment is remitted.
3. Account Cancellation
All account cancellations must be completed by sending an e-mail to support@bigfiber.net accompanied by the domain
name of the account and the administrative password as proof of identity.
4. Limitation of Liability
BigFiber.net assumes no responsibility for lost data under any circumstance. Although we keep current backups for
all applicable accounts, such as shared hosting accounts and e-mail accounts, we cannot be held liable for your data.
In the event that any or all data is lost you are responsible for having your own backups that can be used to restore
your account.
BigFiber.net is not responsible for lost time or lost revenue due to service unavailability or data loss except to the
extent that is agreed upon in our Service Level Agreement below.
5. Service Level Agreement
In order to show that BigFiber.net is serious about the reliability of our services, we offer a guarantee. If you
experience more than 30 minutes of unexpected down time, or 2 hours of scheduled down, within a one month period, we will
provide service to you for the following month free of charge.
If you have a complaint about the activities of any of our clients or any service within our networks please e-mail
abuse@bigfiber.net and we will address your concern according to our acceptable use policy and local governing laws in a
timely fashion.
